Fit Club Rules

SWEEPSTAKES:

Eligibility: The Lifestyle Family Fitness (Sponsor) Fit Club sweepstakes (the “Sweepstakes”) is open to members and non-members who are legal residents of Florida over the age of 18. Entrants must obtain a game piece entry form from any Lifestyle Family Fitness location at the front desk, complete and get signatures or stickers for four (4) fitness classes at Lifestyle Family Fitness during the contest timeframe and turn in game piece entry form to club and/or enter online. See eligibility requirements and rules specifically for the Grand Cayman trip. 

Every guest (non-member) must sign Guest Registry. All employees of Lifestyle Family Fitness (“LFF”) and all associated agencies and each of their respective affiliates, sales representatives, distributors, licensees or agents (all of the foregoing, together with Sponsor, collectively referred to as “Sweepstakes Entities”), and their immediate family members (spouse, parent, child, sibling and their respective spouses) and those living in the same household of each (whether related or not), are ineligible to participate in the Sweepstakes. All applicable federal, state and local laws and regulations apply. Void where prohibited or restricted by law. Entry in the Sweepstakes constitutes your full and unconditional acceptance of these Official Rules. NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. Void where prohibited.

Duration: The Sweepstakes entry period begins at 12:01 a.m. EST on January 16, 2012 and ends at 11:00 p.m. EST, February 15, 2012 (the "Sweepstakes Period"). Winners will be selected from entries properly submitted and timely received during the Sweepstakes Period.

Entry Instructions: During the Sweepstakes Period, entrants may submit their entry at any LFF location. Participants must complete four (4) fitness classes, obtain signatures or stickers from class instructor on their game piece and submit game piece at the front desk of the club. Limit three (3) entries per person for the one-year LFF membership. Limit one (1) entry per person for the Grand Cayman Island trip. Tampa bay area entrants must enter to win Grand Cayman Island trip for two online via the ClearChannel radio station’s website, which can be accessed through the QR code on the game piece or through the station’s (93.3 WFLZ) website.

Publicity: As a condition of entry into the Sweepstakes, except where prohibited by law, each entrant and each winner by accepting a prize grants to Sponsor and its affiliates, legal representatives, assigns and licensees, all right, title and interest in to publicize, broadcast, display and/or otherwise use the Sweepstakes entrant’s name, city, state, and biographical material (collectively, “Licensed Rights”) in any media now or hereafter known throughout the world in perpetuity for advertising and publicity purposes, without additional review, compensation, permission or approval of the winner. Where necessary, the winner will be required to execute and return an Affidavit of Eligibility/Liability and Publicity Release within five (5) business days of attempted notification or the winner may be disqualified and an alternate winner selected.

Selection of Sweepstakes Winners and Odds of Winning: The potential Grand Prize winner will be selected in a random drawing to be held on or about Feb 23, 2012. Winner will be selected from entries received during the Sweepstakes Period. Odds of winning will depend on the number of eligible entries received during the Sweepstakes Period. The potential winner will be notified via email to the email address submitted with the potential winner’s entry within one (1) week after the drawing. The drawing will be conducted by Sponsor, the judge of the Sweepstakes, whose decisions on all matters relating to the Sweepstakes shall be final and binding. In the event that a potential winner is disqualified for any reason, Sponsor may, in its sole discretion, award the applicable prize to an alternate winner selected at random from the entries properly submitted and timely received during the Sweepstakes Period. Any return of prize notification or prize email as undeliverable will result in forfeiture of any prize and an alternate winner may, at Sponsor's discretion, be randomly selected from the entries properly submitted and timely received during the Sweepstakes Period.

Prizes: In Orlando, Jacksonville and Naples/Venice market: grand prize winner will receive a one (1) year Lifestyle Family Fitness membership. There is no runner up in this market. In Tampa Bay, Polk and Sarasota market; grand prize winner will receive a trip for two to Grand Cayman Island. Runner up receives one (1) year Lifestyle Family Fitness membership. No cash value. Terms and conditions apply. Prizes are non-transferrable.

General Rules: By entering or participating in the Sweepstakes, participants agree to be bound by these Official Rules, and by the decisions of Sponsor, which are final and binding in all respects. Modification and/or Cancellation of Sweepstakes: If, for any reason, the Sweepstakes is not capable of running as planned for reasons outside the control of the Sponsor which, in the sole opinion of Sponsor, may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (or portion thereof), Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes (or portion thereof).

Disqualification of Entries: Sponsor reserves the right, at its sole discretion, to disqualify the entry of any individual found to be (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any website operated by the Sweepstakes Entities; (b) using any robotic, macro, automatic, programmed or like entry methods, which will void all such entries; (c) violating these Official Rules or the terms of service, conditions of use, and/or general rules of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person.

Limitation of Liability: Sweepstakes Entities are not responsible for: (1) any incorrect or inaccurate information, printing or typographical errors, or technical failures of any kind, (2) unauthorized human intervention in any part of the entry process or the Sweepstakes; or (3) any other computer, network, technical, human or other error, problem or malfunction that may occur in connection with the administration of the Sweepstakes, the processing of entries, or the selection or notification of winners.

Sweepstakes Entities are not responsible for claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in this Sweepstakes or in any activity or travel related thereto or from any interaction with, or downloading of, computer Sweepstakes information.

By entering the Sweepstakes, all entrants and all heirs agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities against any and all claims, damages or liability arising in connection with each entrant’s participation and/or entry in the Sweepstakes and/or due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in any Sweepstakes-related activity or participation in the Sweepstakes.

Disclaimer of Warranties: Each prize is awarded to the chosen winner “as is” and without any
express or implied warranties by the Sweepstakes Entities, including but not limited to any implied warranty of merchantability or fitness for a particular purpose.

Taxes Related to Prizes: Payment of all federal, state and local taxes related to any of the prizes are solely the responsibility of the winner of the prize. The winners may be required to sign an IRS Form W-9 or the equivalent and may be issued an IRS Form 1099 for the value of their prize.

Privacy Policy: The personal information collected through the Sweepstakes is subject to LFF’s Privacy Policy, located at www.lff.com. By entering the Sweepstakes, all entrant’s agree to the use of the entrant’s personal information as described in LFF’s Privacy Policy.

Rules & Winners’ List Requests: To obtain a copy of these Official Rules or for notification of the winners, send a self-addressed stamped envelope to: LFF’s Fit Club Official Rules & Winners’ List Request, c/o Lifestyle Family Fitness, 140 Fountain Parkway #410, St. Petersburg, FL 33716. Requests for winners' lists must be received within three months after the end of the Sweepstakes Period.

Disputes: All entrants in the Sweepstakes agree, as a condition to participating in the Sweepstakes, that any and all disputes and/or causes of action arising out of or related to the Sweepstakes shall be resolved individually and not in any form of class action. The exclusive venue for any disputes or legal action arising out of or related to the Sweepstakes shall be in the federal or state courts located in or for Pinellas County, Florida. All issues and questions concerning the construction, validity, interpretation and enforceability or these rules and any disputes arising from or related to the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Florida without giving effect to any choice of law or conflict of law rules or provisions that would result in the application of any other state laws.

Severability: If any provision of these Rules and Regulations are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
